Information on data processing and rights related to data processing 


Data of the administrator and the Data Protection Officer 

We inform you that the administrator of your Personal Data is No Fluff Jobs sp. z o. o. with its registered office in Gdynia (81-321 Gdynia) at ul. Podolska 21 (hereinafter also referred to as the "Employer" or "Administrator"). Contact with the administrator is possible via e-mail: careers@nofluffjobs.com or to the provided registered office address, which is also the correspondence address. The data administrator has appointed a Data Protection Inspector, who can be contacted at the e-mail address: privacy@nofluffjobs.com.

Purposes and legal basis of data processing:

The personal data you provide will be processed by the administrator for recruitment purposes, based on:

  1. a specific legal provision regulating the collection of data from a person applying for employment based on an employment contract (Article 6, paragraph 1, letter c of the GDPR* in connection with Article 221 § 1 of the Labour Code), i.e. in the case of offering employment based on an employment contract and providing only the data covered by this provision, i.e.: first name(s) and last name, date of birth, contact details indicated by you and education, professional qualifications and course of previous employment, if they are necessary for the Employer to perform work of a specific type or in a specific position, or 

  2. based on your consent - in accordance with Article 6 paragraph 1 letter a of the GDPR:

  • in the case of the current recruitment process: an employment contract is offered and for recruitment purposes you provide in your CV or application documents other data than those that the Employer may process based on the Labor Code, i.e. other than: first name(s) and last name, date of birth, contact details provided by you and education, professional qualifications and course of previous employment, if they are necessary for the Employer to perform work of a specific type or in a specific position or 

  • in the case of the current recruitment process: a contract other than an employment contract is offered (e.g. a contract for services), and the processing of data applies to all data that you provide in your CV or application documents for processing in order to carry out the recruitment process, or

  • if you wish to take part in future recruitment processes with the Employer (the processing of data applies to all data that you provide in your CV or application documents for processing in order to carry out future recruitment processes).


Due to the nature of the recruitment process (or processes) conducted via the elevato electronic system, your e-mail address will be processed for the purpose of identifying the Candidate in the elevato system. Such an identification function helps to properly implement your rights resulting from the GDPR, e.g. withdrawal of consent, updating data, obtaining their content, etc. This constitutes a legitimate interest of the data controller, and the legal basis for processing is Art. 6 sec. 1 letter f of the GDPR.

The legitimate interest of the data controller is also the archiving of data after the recruitment process has been completed or after the withdrawal of consent to the processing of data in future recruitment processes. Such archiving serves evidentiary purposes for the defense, establishment or pursuit of claims, based on Article 6 paragraph 1 letter f of the GDPR. 


Data recipients

Personal data may be disclosed to employees or associates of the data controller, as well as to entities providing support to the controller on the basis of commissioned services and in accordance with concluded entrustment agreements, especially in the area of recruitment support. 

The recipient of the data is, among others, elevato SA with its registered office in Bielsko-Biała, ul. Batorego 3/6, 43-300 Bielsko-Biała, as the entity providing and maintaining the elevato system, used to support recruitment conducted on behalf of the data controller.  

Data storage period

The data will be processed until the recruitment process is completed, no longer than 12 months from the date of application submission or for the period indicated in any consent for future recruitments, no longer than one year from the end of the recruitment process. In the event of expressing a desire to participate only in future recruitment processes, the data will be processed for no longer than 12 months from the date of application submission.

Entitlements

You have the right to request access to your personal data, the right to rectify, delete or limit processing, as well as the right to object to processing and the right to transfer data. You can withdraw your consent at any time. Withdrawal of consent does not affect the lawfulness of processing based on your consent before its withdrawal. You also have the right to lodge a complaint with the President of the Personal Data Protection Office ( https://uodo.gov.pl ). 


The necessity of providing data and the consequences of not providing it

In the case of a recruitment process concerning employment based on an employment contract, the Employer may request the provision of data in the scope indicated in the Labor Code, i.e.: first name(s) and last name, date of birth, contact details provided by the Candidate and education, professional qualifications and course of previous employment, if they are necessary for the Employer to perform work of a specific type or in a specific position. If the Employer marks this data as necessary, their provision is a requirement to participate in the recruitment process, and refusal to provide them will result in the inability to participate in the recruitment process. In the case of data not required by the Labor Code, their provision is voluntary and failure to provide data does not affect the possibility of participating in the recruitment process. 

In the case of data provided during recruitment for a position for which a civil law contract is offered, the requirement to provide data does not result from the provisions of law (their provision is voluntary), however, providing adequate data marked by the Employer is necessary to reliably start the recruitment process. Refusal to provide such data will result in omitting your candidacy in the recruitment procedure. In the case of data other than those marked as necessary, failure to provide them does not affect the possibility of taking part in the recruitment. 

In the case of an e-mail address, which is a field marked as required (identifying data allowing us to correctly identify you in the system), failure to provide an e-mail address will prevent you from participating in the recruitment process conducted by the recruitment system. 

We would like to inform you that decisions regarding the recruitment process will not be made in an automated manner.
